These terms and conditions apply to all projects and services that Fireheart Digital Limited undertakes.

1. Acceptance.

A copy of these terms and conditions can be supplied along with project proposals and must be agreed upon before work commences. Alternatively, payment of an advance fee, deposit or any payment is an acceptance of our terms and conditions. These terms and conditions are always available upon request.

Services to be provided by Fireheart Digital Limited are defined in the ‘proposal’ that the Client receives via email. Quotations are valid for 30 days unless the Client has agreed on alternate timescales beforehand. Fireheart Digital Limited reserves the right to alter or decline to provide a quotation after the expiry of the valid timescale.

2. Communication

The Client agrees to delegate a single individual as the ‘first point of call’ to aid Fireheart Digital Limited with completing the services satisfactorily and efficiently.

We strive to respond to all communications promptly and will provide an initial reply as soon as possible. However, a more formal response or solution (sometimes temporary) will be provided within 24 working hours. Calls and WhatsApp are welcome; however, all briefs or approvals must be submitted via email. WhatsApp is primarily for sharing content i.e. photos.

Our normal office hours are Monday–Thursday, 9 am – 5 pm and Friday 9am - 3pm.

However, due to the reactive nature of our work, we are available outside these hours with notice at an additional charge at the discretion of Fireheart Digital Limited. Unless otherwise specified, travel expenses for on-site meetings or collaborations may be chargeable to the client.

3. Review

The client agrees to review deliverables within the time identified for such reviews and to promptly either (i) approve the deliverables in writing or (ii) provide written comments and/or corrections sufficient to identify the client’s concerns, objections or corrections.

Digital Marketing

Fireheart Digital Limited will provide the Client with the opportunity (if required) to review and approve any content for social media, the website, emails, blogs, etc., within three working days, unless agreed otherwise.  We will allow up to 2 rounds of amends; any additional amends may be chargeable at the discretion of Fireheart Digital Limited.

Fireheart Digital Limited will allow the Client to test the website’s functionality, appearance, and content during the design and development process, as well as after completion. We will allow up to 2 rounds of amendments; any additional amendments may be chargeable at the discretion of Fireheart Digital Limited. After project completion, it is deemed accepted and approved unless the client notifies Fireheart Digital Limited within 10 working days.

4. Schedules

All Digital Marketing

We will prioritise and perform the services within the time(s) identified in the Proposal.

The ability to meet any schedules is entirely dependent on the client providing up-to-date content when requested, written approvals and/or instructions outlined in the proposal. Any delays in the client’s performance or changes in the services or deliverables requested by the Client may delay delivery of the deliverables. Any delay caused by the Client shall not constitute a breach of any term, condition, or obligation under this Agreement.

Web Design

Fireheart Digital Limited will deliver the Client’s Website in most projects by the date specified in the proposal. If no such date is selected, the timescale shall be within 180 days of the date initial payment is received from the Client unless a delay is specifically requested by the Client and agreed upon by Fireheart Digital Limited. An alternate timescale can be agreed upon during the initial project discussion.

Fireheart Digital Limited requires the Client to provide relevant and correct content when asked. Suppose the requested content is not provided within 4 weeks of an official email request. In that case, Fireheart Digital Limited reserves the right to notify the Client of a revision to the final payment fee. This revision will be based on any new or updated schedules or pricing introduced during that time.

If the content is not provided within 8 weeks from the original email request, the Client will be considered in default of the project. The project will be terminated, and the Client will be sent a final invoice for immediate payment to date. Fireheart Digital Limited reserves the right, at its discretion, to recommence the project after an agreement is reached on a revised quotation document and once the original fees have been settled.

5. Payment

Fireheart Digital Limited will provide invoices for Marketing, Web Development and any associated services. Invoices are sent via email using XERO. Invoices are due within 14 days of receipt. After this period, a reminder will be sent to the Client. If the invoice has not been settled within 30 days, Fireheart Digital Limited will consider the account to be in default. Payment for services is due by bank transfer or GoCardless.

Payment for web design does not cover the transfer of Graphic source files, Flash files, or website source code. If the Client requires these items, a separate quotation can be prepared (if required).
